Terms of Service

1. Acceptance of Terms

By visiting our website, creating a client account, or purchasing any hosting plan (including Minecraft, GTA V/FiveM, Hytale, Cloud VPS, or Discord Bot Hosting), you acknowledge that you have read, understood, and agreed to be legally bound by these Terms of Service.

2. Account Security & Ownership

Clients are solely responsible for maintaining the confidentiality of their login credentials (including client portal passwords, Pterodactyl panel access, and SSH/SFTP keys). You agree to notify us immediately of any unauthorized access to your account. FuriousCloud will never request your account password.

3. Acceptable Use Policy (AUP)

You agree to use our infrastructure strictly for lawful computational, hosting, and gaming purposes. The following activities are strictly prohibited and will result in immediate service termination without notice or refund:

• DDoS & Network Attacks: Launching, relaying, coordinating, or participating in Denial of Service attacks or packet floods.
• Port Scanning & Exploitation: Unauthorized probing, network vulnerability scanning, brute-forcing, or port abuse.
• Cryptocurrency Mining: Unauthorized CPU/GPU mining (e.g., Monero, Bitcoin) on game nodes or shared VPS instances without dedicated bare-metal authorization.
• Malware & Phishing: Distributing trojans, spyware, ransomware, keyloggers, or hosting fraudulent phishing portals.
• Spam & Unsolicited Bulk Mail: Operating open mail relays, bulk email bots, or sending unsolicited marketing broadcasts.
• Copyright Infringement: Hosting pirated software, cracked game files, or unverified copyrighted assets without appropriate publisher licensing.

4. Server Resource Usage

While FuriousCloud enforces a strict zero-overselling policy for your dedicated RAM and vCPU cores, instances running intentional fork-bombs, memory-exhaustion scripts, or infinite loops designed to freeze host hypervisors will be automatically throttled to preserve host cluster stability.

5. Backups & Data Responsibility

Although FuriousCloud maintains disaster-recovery snapshots across our datacenter nodes, the client is responsible for creating and downloading periodic off-site backups of their game world saves, custom plugins, database dumps, and server configurations. FuriousCloud is not liable for data loss caused by customer misconfiguration, malicious plugins, or third-party exploits.

6. Billing, Renewals & Invoices

All services are billed on a recurring pre-paid monthly basis unless an annual or quarterly term is explicitly selected. Invoices are generated 7 days prior to service expiration. If an invoice remains unpaid 48 hours after the due date, the server will be suspended. Data on suspended instances is retained for 7 calendar days before automated disk reclamation.

7. Suspension & Termination

FuriousCloud reserves the right to suspend or terminate services immediately upon discovery of material violations of our Acceptable Use Policy, fraudulent payment transactions, or compliance with legitimate law enforcement requests.

8. Limitation of Liability

To the maximum extent permitted by applicable law, FuriousCloud Networks Ltd. and its officers, directors, and employees shall not be liable for any indirect, incidental, punitive, or consequential damages resulting from downtime, network disruptions, data loss, or server misconfiguration.
